1. Overview

These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Step.co Technology Inc. ("Step.co", "we", "our", or "us") governing your access to and use of our websites, mobile applications, digital content, and any related services (collectively, the "Services"). By creating an account, purchasing a subscription, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & Age Restrictions

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account. Users aged 13–17 may use the Services only under the direct supervision of a parent or legal guardian who accepts these Terms on their behalf. The supervising adult is fully responsible for the minor's activities and agrees to indemnify Step.co against any claims arising from such use.

3. Account Registration & Security

You agree to provide accurate information during registration and to keep it current. You are responsible for safeguarding your password and for all activities under your account. Notify us immediately of any unauthorised use. We may suspend or terminate your account if we suspect a breach of these Terms.

4. Subscriptions, Payments & Refunds

• Billing: Certain features require a paid subscription. Fees, billing interval, and currency will be disclosed at the point of purchase and may automatically renew until cancelled.
• Payment Processing: We use third‑party processors (e.g., Stripe) to handle payment information securely. Step.co does not store full card numbers.
• Cancellation: You may cancel at any time via your account settings, effective at the end of the current billing cycle.
• Refunds: Unless required by law, payments are non‑refundable except for first‑time subscribers who cancel within seven (7) days of purchase.

5. Licence & Acceptable Use

We grant you a limited, non‑exclusive, non‑transferable, revocable licence to stream our content for personal, non‑commercial use. You may not:

• Share, copy, record, rebroadcast, or otherwise distribute our classes or materials.
• Modify, decompile, or reverse engineer any part of the Services.
• Use bots, scrapers, or similar methods to access data without permission.
• Exploit the Services for commercial or public performances.

All content, trademarks, and software remain the exclusive property of Step.co.

6. User‑Generated Content

If you post comments, reviews, photos, or other content ("UGC"), you grant Step.co a worldwide, royalty‑free, perpetual licence to use, display, reproduce, and distribute that UGC in connection with the Services. You represent that you own or have the rights to the UGC and that it does not infringe any third‑party rights or violate any law. We may remove UGC that violates these Terms or is otherwise objectionable.

7. Safety, Health & Assumption of Risk

The Services provide general fitness and wellness information and are not a substitute for professional medical advice. Consult a qualified physician before starting any new exercise program. By participating, you acknowledge the inherent risks of physical activity and assume full responsibility for any injuries or damages that may occur.

8. Termination

You may stop using the Services at any time. We may suspend or terminate your access immediately for breach of these Terms, illegal conduct, or to protect the integrity of the platform. Upon termination, the licence granted to you ends and we may delete or deactivate your account data, subject to our Privacy Policy.

9. Disclaimers & Limitation of Liability

The Services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non‑infringement. To the fullest extent permitted by law, Step.co shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising out of or relating to the Services shall not exceed the greater of CAD 100 or the amount you paid to Step.co in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above may not apply to you in full.

10. Indemnity

You agree to defend, indemnify, and hold harmless Step.co and its directors, officers, employees, and affiliates from any claims, damages, losses, and expenses (including legal fees) arising out of or related to your breach of these Terms or misuse of the Services.

11. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of these Terms or the Services shall be resolved by binding individual arbitration administered by the British Columbia International Commercial Arbitration Centre ("BCICAC") under its Shorter Rules. The seat of arbitration shall be Vancouver, BC, and the language shall be English. You waive any right to participate in class actions or class‑wide arbitration.

12. Miscellaneous

• Governing Law: These Terms are governed by the laws of British Columbia and federal laws of Canada.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• Assignment: Step.co may assign these Terms; you may not assign without our consent.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between the parties.
• No Waiver: Our failure to enforce any right shall not be deemed a waiver of future enforcement.
